A. The following are the terms and conditions for use of Pelle Care Products Ltd (hereinafter referred to as “Pelle Care Products Ltd”) website, with domain name,
www.pellecare.co.nz ("the website").
B. The website is owned, hosted and maintained by Pelle Care Products Ltd.
C. By accessing and using the website, you (“the user”), agree to be legally bound by the terms and conditions as are set out in this notice. The user is therefore urged to familiarise his /herself with these terms and conditions prior to the usage of the website. If the user does not wish to be bound by these terms and conditions, then he / she may not access, display, use, download and/or otherwise copy or distribute any of the content of this website.
1. USER PRIVACY
1.1 To ensure acquaintance with and awareness of the privacy measures and polices of Pelle Care Products Ltd, the user acknowledges that he / she has read and understood the underlying privacy clauses incorporated in these terms and conditions:

b) for Pelle Care Products Ltd to continually assess the popularity and use of the website and improve it for the users, the website server will collect information to measure the number of visits, average time spent at the website, pages viewed, etc.
c) Pelle Care Products Ltd however assumes no obligation to protect any user’s information, but does guarantee not to distribute or share a user's information with any third party.

e) violate any applicable laws or regulations.
3. UPDATING OF THESE TERMS AND CONDITIONS
3.1 Pelle Care Products Ltd reserves the right to, from time to time and at its own discretion, change, modify, add to or remove from portions or the whole of the terms and conditions. Changes to the terms and conditions will become effective upon such changes being posted to the website. It is thus the user’s obligation to at all times, check the terms and conditions on the website for changes or updates.
3.2 The user’s continued use of the website following the posting of changes or updates will be considered notice of the user’s acceptance to abide by and be bound by the terms and conditions, including such changes or updates.

4.3 While Pelle Care Products Ltd will take every effort is made to ensure that the information provided on the website is current and accurate, the user should not assume that the information on the website is always current or accurate, and other sources of this information should be consulted before making any decision to act on the information displayed on this website and the user acknowledges that he / she will not hold Pelle Care Products Ltd, its parent companies, subsidiaries, affiliates, directors, employees, officials, suppliers, agents and/or representatives, under no circumstances and will keep them fully indemnified, from and against any loss or damage suffered or liability incurred in respect of any third party, which arises from the user’s use of the website, and such loss or damage may include but not limited to, liable for any defamatory, offensive or illegal conduct of other users or third parties.
4.4 The user acknowledges that he / she will not hold Pelle Care Products Ltd, its parent companies, subsidiaries, affiliates, directors, employees, officials, suppliers, agents and/or representatives liable for any direct, indirect, punitive, incidental, consequential damages, or any damages whatsoever arising from the use of this website regardless of how the damages arise, which damages may include but not limited to:

9. DISCOUNTS AND VOUCHERS
All discounts and vouchers issued by Pelle Care Products Ltd, shall be redeemable only on products advertised at full retail price. Discounts and vouchers are not available cumulatively with any other offers made on the website. We also reserve the right to exclude any categories included in the range of products made redeemable for such discounts and vouchers.
10. SERVICE Terms and conditions
Pellé® and the Pellé logo are registered trademarks of Pelle Care Products Ltd in New Zealand. All work undertaken by Pelle Care and/or its agents is subject to the terms and conditions outlined on this page.
PAYMENT: Terms are payment strictly upon completion of work, except in the case of insurance excess payments; where Pelle Care is directed to collect the excess payment for approved insurance repair work, such payment is to be made by the claimant in advance of the commencement of said work. Online payment through direct credit into our bank account is preferred. Credit card payment through the secure online payment system is acceptable but incurs a small processing fee. All products and services are subject to Goods and Services Tax (GST).
TRAVEL CHARGES: On-site estimates and work undertaken outside of Timaru are subject to travel charges at the discretion of Pelle Care and in accordance with the current standard mileage rate recommended by Inland Revenue.
TRANSPORTATION & TRANSIT INSURANCE DISCLAIMER: Transportation of any and all furniture items to and from our premises is the responsibility of the client. Where we are asked to arrange for transportation of furniture items, appropriate charges will apply. While all care is taken to transport furniture safely and securely, transit insurance is entirely the responsibility of the client. No responsibility will be accepted by Pelle Care and/or its agents for damage to or loss of items being carried in transit.
STORAGE & STORAGE INSURANCE DISCLAIMER: Storage of furniture, vehicles, and other goods at our premises is undertaken at the client's risk. While all care is taken to store furniture items safely and securely, storage insurance is entirely the responsibility of the client. No responsibility will be accepted by Pelle Care and/or its agents for damage to or loss of items being stored at our premises or other designated secure locations.
WARRANTY DISCLAIMER: It is accepted by the client that Pelle Care and/or its agents have been engaged by the customer as a result of flaws, damage, excessive or normal wear to the material, or a desire to improve the appearance of the leather to the item that is being restored. It is understood that Pelle Care and its agents accordingly do not offer a general warranty of the repaired item, nor do we state the item will be returned to good-as-new condition.
REPAIRS DISCLAIMER: Due to the nature and differing characteristics of leather materials available on the market, Pelle Care cannot guarantee that every repair will turn out to be invisible. Every effort will be made by the Leatherwise technician to qualify as accurately as possible the likely end result of a repair being undertaken.
CANCELLATIONS: Cancellations by customers after the required products are purchased for the specific project will be paid for by the customer as each leather colour product is custom mixed for the specific project.
11. APPLICABLE LAW
9.1 This website is owned, operated and hosted within New Zealand, as such, these terms and conditions shall be governed by the laws of New Zealand.
9.2 The user hereby submits and consents to the jurisdiction of New Zealand.
12. ENTIRE AGREEMENT
These terms and conditions constitute the entire agreement with respect to use of the website and supersede any and all previous agreements, either verbal or written, with
respect to the use of this website.
